Planning in Leamington Spa, Warwick and Kenilworth
The district combines three quite different towns. Royal Leamington Spa is a Regency spa town of stucco terraces, crescents and squares, with a large student and rental population. Warwick is a medieval county town grown up around its castle. Kenilworth, to the north, sits among Green Belt countryside next to the ruins of Kenilworth Castle. Whitnash and the southern urban extensions complete the main built-up area.
The Warwick District Local Plan 2011 to 2029 was adopted in September 2017 and remains the development plan. It sets a minimum of 16,776 new homes over the plan period in Policy DS6, and its development management policies are still applied to most applications, including Policy BE1 on layout and design, Policy BE3 on amenity and Policy TR3 on parking.
That plan is being replaced. Warwick District Council and Stratford-on-Avon District Council are preparing the joint South Warwickshire Local Plan, which will run to 2050. The Regulation 19 publication consultation took place between 21 July and 8 September 2026, and the councils aim to submit the plan for examination by 31 December 2026. Emerging policies gain weight as the plan advances, so schemes designed now should look at both documents.
Neighbourhood plans add another layer in parts of the district, including Kenilworth. We check which plans apply to the parish at the outset, so that design, housing mix and parking are argued against the right policies from the first drawing.

We advised a client before they bought a three-storey office building in the Royal Leamington Spa Conservation Area, then secured Class MA prior approval for six flats from Warwick District Council on the first submission, with no external alterations. Leamington Spa and Warwick planning issues
Since 1 April 2012 an Article 4 Direction has removed permitted development for changing a house to a small HMO anywhere in Leamington Spa. Planning permission is needed, and Policy H6 applies.
Large parts of Leamington Spa, Warwick and Kenilworth are conservation areas. Policy HE2 applies, and even ground-floor changes of use can need a heritage statement, as our Class MA project showed.
Regency terraces, Warwick's historic core and the settings of the two castles bring Policy HE1 into play. Alterations, extensions and new buildings nearby are tested on their effect on significance.
Green Belt surrounds Kenilworth and much of the northern district. Policy DS18 and national Green Belt policy, including the newer grey belt tests, decide what can be built beyond the town edges.

Housing in multiple occupation is the issue that most sets Leamington Spa apart. The Article 4 Direction brings small HMOs for three to six people into planning control across the whole town, and Policy H6 of the Local Plan governs both HMOs and student accommodation. The council's HMO guidance uses a 100 metre radius test to judge concentration, so the existing mix of properties around an address is central to any application. Heritage is the second theme. Policies HE1 and HE2 protect designated heritage assets and conservation areas, and many streets in Leamington Spa, Warwick and Kenilworth fall within one or both. Applications that treat heritage as an afterthought are the ones most likely to stall at validation or be refused.
Office-to-residential conversion is a live opportunity in the town centres. Class MA permitted development no longer carries a floorspace cap or vacancy test, but conservation area locations bring the impact of a ground-floor change of use into the prior approval assessment. Can an office in Leamington Spa be converted to flats without full planning permission?
Often, yes, through Class MA prior approval, provided the building qualifies and the matters reserved to the council are satisfied. Do I need planning permission for a small HMO in Leamington Spa?
Yes. An Article 4 Direction in force since 1 April 2012 covers the whole of Leamington Spa, so changing a family house to a small HMO for three to six unrelated people needs planning permission. Applications are judged against Policy H6 and the council's concentration test. Larger HMOs for more than six people always need permission.
Will I need a heritage statement for my Warwick District application?
If the property is listed, in a conservation area or affects the setting of a heritage asset, almost certainly. That covers much of central Leamington Spa, Warwick and Kenilworth. A heritage statement should explain the asset's significance and the effect of the proposal, in proportion to the scale of the works.
Which local plan applies in Warwick District?
The Warwick District Local Plan 2011 to 2029, adopted in September 2017, is the development plan. The joint South Warwickshire Local Plan with Stratford-on-Avon will replace it once adopted, and it is targeted for submission for examination by the end of 2026. Neighbourhood plans also apply in some areas, including Kenilworth.
Can I extend my house in the Green Belt near Kenilworth?
